Try it yourself: go to the settings, Kinect and look what Kinect can see. Than cover the main camera lenses and I mean just the camera. As you change to the infrared view you can still see everything clearly. Those red lights will turn off as soon as you start a game but at apps or the dashboard they are constantly watching you. If it wasn't bundled, maybe be the Xbox One would have started slightly better against PS4 (there are other factors, but $100 difference definitely didn't help), and give a better idea to game studios of the actual user-base of Kinect : X million Kinect bundled with console doesn't mean that X million of players are willing to move their body
